March 23, 2013 16:54:40 Observer   As I recall our Superintendent, as good as he is, was not changed from Elective to Appointive by referendum. But, rather he was just appointed to the position by vote of the Town Board. Personally I would like to see our Town Board take care of the matter so it does not come up in the future. Too lose a good working Superintendent due to an oversight would be too bad.
March 23, 2013 16:50:12 Observer   Town Highway Superintendents State statute requires that all towns have a superintendent of highways, either elected or appointed. Whether elected or appointed, the superintendent is an independent town officer with powers independent of the town board to employ and direct employees to carry out his statutory responsibilities. The superintendent has a fixed term of office whether elected or appointed, which is two years, but can be set at four years locally. The town can change the office of highway superintendent from an appointive office to elective by resolution subject to permissive referendum, but to change from elective to appointive would require a local law subject to mandatory referendum. Prior to 1974, the office could be made appointive by resolution subject to permissive referendum, but that provision of Town Law was repealed. Currently, out of 932 town highway superintendents, only 59 are appointive rather than elected. Responsibilities of the town highway superintendents, whether elective or appointive, include preparing of an annual budget (subject to the modification and approval of the town board), the general maintenance of the town highways, bridges, sidewalks, culverts, and ditches. They can also bring actions in court relating to town highways. Additionally, towns with a contract with another municipality to provide highway maintenance and repair that is in effect for five years may adopt a local law subject to permissive referendum to abolish the office of town highway superintendent. NOTE ACCORDING TO NYS LAW THE SUPERINTENDENT IS INDEPENDENT FROM THE TOWN BOARD. Thus I understand the Town Board cannot require any set hours. Of the 932 Road Supers in the state only 59 are appointed like ours is. (From the New York State Association of Road Superintendents.)
March 22, 2013 23:27:57 what?   I should stay out of this but; if Duane served 10 years as the ELECTED head of the highway department,an employee before that, the people of the TOM knew him pretty good, and elected him to do the job he did. Like I said before, some of you might have the cabin fever, get out , get some sun, even though it is winter, the sun shines most days. I didn't personally know Duane, but I grew up with his wife, K-12, K-5 in the school formally known as Masonville school, and I can't imagine how they would feel if they popped on this website and read the posts in the last couple days, (or his mother!), shame on you! I would like to complain about how Obama is ruining this country (he is), but i'm too piissed off to.

Not all of our highway superintendents were hired as 40 hour a week workers. Some were hired to plan work, attend meetings and do other work as needed, but not required to be at work 40 hours each week. Please be sure of your facts before insulting people. Duane Gifford was not hired to be at work the 40 hours.

His place looks nice, my place looks nice, if someone's doesn't, their choice, it's their property they pay taxes on. Laws forcing people to comply with certain peoples ideas will lead us to mandatory snow plowing, lawn mowing, watering and fertilizing, heck they might require us to all have garden gnomes or be fined! Live your life happy, don't worry about the neighbors, if you want perfection move to a suburb somewhere.

March 20, 2013 17:07:25 another long time resident   Please get facts straight before commenting. Carl Gifford was Town Supervisor not Hwy Supervisor. Duane Gifford was the Hwy Supervisor to start only working two hours a day and working else where while getting the same pay as previous Hwy supervisors. All mechanical work was done in the shop before Duane. Glad to see that they are doing work in shop again. If you really want something to complain about, how about the run down and falling down properties and buildings. Also places with junk and garbage all over the place. These properties make the people who have pride in our town look bad as it reflects on all of us. Where's the code officer in all of this. Can't he issue warning or tickets to help clean up our town so it looks nice? There are people who will haul junk away for free or a small price. We need the clean up days like the town had up until last year.

As it was when they built the new town hall, that I personally was against, but it was good to hear of all the savings that was involved,ie;our newest Supervisor Spaccaforno donation of skills,time,materials, our road crew's help (even though it apparently wasn't their job, but I think Dumond said they could if it was their choice)and everyone else's help . I know some people are against 'thanks', but I give a big thanks for our Masonville town board standing up for our Constitutional rights in their opposition to Cuomo's anti-gun owner Act, towns all around us are also publicly opposed,THANK you.
March 20, 2013 11:28:24 what?   Reading the March minutes on what Mrs. Ryan had to say about Steam Mill, I agree, when they did Cummings road we got to deal with mud for months, I would have rather negotiated the potholes, after they finished all was good though.I don't know what the gray stuff is on Steam Mill, it through my vehicle out of control and I wasn't even going fast, a road warning sign would have helped. The town needs to think about what time of the year they are starting projects,and if there is enough time to finish them before bad weather.

March 19, 2013 19:59:00 Sick of What!   Lloyd darling, like many of the previous supers, was a joke! The men didnt listen to him and rather did whatever they wanted. The previous supers worked maybe 2 hours per day and collected a full paycheck. I have lived in this town my whole life too and am proud to see a super who works full time right along with the men, proud of our updated equiipment and happy with our roads for the most part.

We have a highway Superintendent who works a 40 hour week and more when needed, We have a highway Superintendent who is with the small crew we have all the time; working side by side with them. So let's get rid of him and elect a Superintendent who "might" spend 2-3 hours a day sitting behind a desk or driving around in a pickup. And let's make sure this elected Superintendent knows as little as possible about road maintenance. No, the road department is not a money maker but it sure has been a money saver over the past few years. Masonville is the laughing stock of the Tri-County area? Obviously you have not traveled to many of the areas outside of Masonville. My daughter, in her job with Delaware County, must travel to ALL the schools in the County and many, many homes in the back roads of Delaware county. She does this on a daily basis 5 days a week. I have asked her about the problems she has faced and she tells me that really if one knows how to drive and is careful the roads in Delaware County and Masonville are not that bad. They are what one would expect of rural roads in the winter. So let's be concerned about what is really costing the taxpayers. UNFUNDED mandates from the State and Federal governments.

I sleep good at night knowing our elected officials in our small town, the volunteers, town board, road crew, fire dep. do the best job they can, I don't think any of them are trying to put the screws to us like Obama and Cuomo ARE. Start asking THEM some questions, like why has the national debt went up more in Obama's reign than all the Presidents combined even after revenue(taxes) are at historical highs?(the govt. took in more tax money this year than any other year in history, and still spending a $trillion more than they took in (Obama said "We don't have a spending problem!")(even with 8.5 million less jobs in the last four years)? Ask Cuomo why is the unemployment rate in NY way above the national average (it isn't good either) and higher unemployment today in NY than this time last year when Obama is saying we have had 36 months of consecutive private sector job growth? (obviously they are all lying,monthly job losses have consecutively outpaced job creation, just because they are no longer eligible for unemployment doesn't mean the are employed, but they don't want to report or have you know that). I think our little town is doing better than the National average on spending our hard working taxpayer money.

WE should all look to the board of commissioners for the answer to this. I find it amazing that they are going to use another departments piece of equipment to serve our good town of Masonville. What if it breaks down enroute to your house buring and because of that you no longer have a home to live in and then your taxes go up because you have to pay for a new fire truck for another department. The town has some serious explaining to do as to why they won\'t pay for the department to get a new fire truck to keep our good Town of Masonville safe. What are your thoughts? If you don\'t believe me check it out for yourself.

That means thousands spent on trucks will not get us less road work. Anyway we all have forgot about the tens of thousands the highway supt. and crew saved ALL OF US on the last plow truck salvaged from the army to put in our fleet,remember the camo truck.....looks quite different now,hope to see in the parade!!!! But all of you could be right on a change of command cause we really should be purchasing NEW trucks like other towns can and paving miles of roads no mater what the taxes are. March 09, 2013 16:02:30 Summer is coming!   I\'ve driven Steam mill road for over 20 years. When the only pavement was at the driveway entrances of less than 12 houses on the road. Peoples kids road the buses and no one got hurt. The only reason the road got more pavement was because years ago the highway super. got it for a good price. It is what it is. Deal with it or don\'t go joy riding up there.

Any unlicensed dog that is picked up by the warden must be licensed before it is returned, but doesn't stop them from running around. Might help rabies because it is required. Mostly just gives Government bureaucracy more of our money. Dog licensing dates back to 1894 when it was started to help pay for dogs that damaged or killed farm animals including chickens. Is this what it is used for today? Or is our Govt. just taking our money?The Dept. of Ag. says "(since 1894) the need for livestock indemnification, as well as the concern for rabies in dogs has diminished significantly."

March 02, 2013 09:03:10 what?   Dog licensing was originally started to pay farmers reparations for livestock damage done by dogs, not to profit off dog owners. Besides that I don't think the town makes any money off it anyway. It used to be run by the state, now it is a unfunded mandate the town and cities must pay for it themselves, and then give a chunk of it to the state.

March 01, 2013 18:11:57 Old Fa rt   Not all of us make the kind of money some people here makes and can afford the best for their pets,us regular citizens,just cant feed our pets the best,most of our income is going towards taxes.
March 01, 2013 13:12:05 Observer   I am feeling despair after watching, briefly, court proceedings on TV. The conclusion is that USA justice is no better; and probably worse, than the rest of the world. Defendants are considered guilty as soon as they have any interaction with law enforcement. Then if they are arrested they are tried and convicted in the court of public opinion and if interesting enough they are then tried, convicted, retried and reconvicted at least 100 times by TV. We tell the defendant he or she is considered innocent until proven guilty in a court or by a jury of his or her peers; but yet we will keep the "innocent" defendant in prison for 5 or 6 years awaiting his or her day in court. Justice is no better than the shyster one can afford. If you cannot afford a shyster on your own then the court will appoint one. Generally the Public Defender and that Public Defender is only interested in his or her paycheck and the person they are supposedly representing plead to some charge; guilty or not. It is a good thing intelligence is not a requirement for lawyers, judges and law enforcement. If it were we would not have anyone in those positions. Any shyster will defend a person to the limit of that persons finances. Then that person is on his or her own.

Febuary 25, 2013 22:56:31 what?   I bet PETCO is supportive of all you want them to be, they need your dollar just like all the mom and pop stores that are in the area, PETCO has over a thousand stores coast to coast. I go for the bottom dollar also, that is why with my adult dogs I go against what I preach and shop at Wally Mart and Tractor supply, I bought the 'good' stuff when they were little at the mom and pops. The mom and pop stores I recommended have the same high end dog food natural, holistic and organic dog food that PETCO advertises at pretty much the same price and you don't have to spend the liquid gold (gas). FYI, also, PETCO in Johnson City September 2011 failed to evacuate its animals during tropical storm Lee. 100 animals drowned when staff failed to move them to safety.Petco claimed that the casualties were caused by a backup in the store's drain/sewage line, and not by the flooding that had submerged the store with four feet of water.Johnson City Mayor Dennis Hannon has called Petco's initial claims "absurd", and stated that "With all the flood warnings and evacuation orders that were issued, for them not to go down there is just absolutely disgusting",he also said "“If someone was aware that those animals were in danger and didn't take the appropriate action to remove them to safety then that is a crime under New York State Law” and charges could be filed against management, he said, adding that some employees asked to take the animals home and been told they could not. The employees were told they could not take the animals home, which may have saved their lives, 100 of them.
